Attending court can be stressful, so here are some helpful tips on etiquette and procedures to ensure a smooth experience:
Dress code: Dress respectfully and modestly. Neat and tidy attire is appropriate.
Punctuality: Arrive at least five minutes early unless instructed otherwise.
Court House security:
- When entering the Court House precinct, you will be required to go through a security check similar to an airport. This includes bag x-rays and a walk-through metal detector.
- To avoid any awkward delays with security, ensure you do not have prohibited items in your bag or on your body (eg, firearms, knives, glass objects, tools, scissors or other sharp objects).
- You must not use your phone or other device to record sound or images within the Court House precinct unless you have been given permission by the judicial officer.
Courtroom decorum:
- Remove sunglasses and hats before entering.
- Do not bring food or drinks into the courtroom. You may bring a clear plastic bottle of water, but you should refrain from drinking from it while court is in session.
- Switch off your mobile phone completely to avoid disruption. You cannot use your phone in court unless you are a lawyer or otherwise have approval by the judicial officer.
- Avoid talking or making noise. If you need to talk to your lawyer, you should do so in a quiet whispered voice.
Court proceedings:
- When the session begins, the court officer will announce the Judge or Magistrate’s arrival. Everyone must stand silently.
- After the Judge or Magistrate enters, they will bow and you should return a small bow of your head in respect.
- If you need to address the Judge or Magistrate, use the term “Your Honour.”
- When entering or leaving the courtroom, face the Bench and bow – you are not bowing to the judicial officer, but are bowing to the Coat of Arms above the judicial officer as a sign of respect to the legal system and the Court’s authority.
- If you arrive while court is in session, enter quietly, bow, and take a seat in the designated public gallery or as instructed.
